Part 2 - Particulars Of Decision
Rossendale Borough Council hereby give notice that planning permission has been granted for the execution of works referred to in Part 1 hereof in accordance with the application and plans submitted subject to the following conditions and reasons:1The development hereby permitted shall be begun not later than the expiration of three years beginning with the date of this permission. Reason for Condition: Required by Section 51 of the Planning and Compulsory Purchase 2004 Act.2The development shall be carried out in accordance with drawing numbers 08-017-05-G, 08-017-06-C, 08-017-07-D & 08-017-08-D, and date stamped 11 Dec 2012, unless subsequently amended and approved in writing by the Local Planning Authority. Reason for Condition:To ensure the development complies with the approved plans and for the avoidance of doubt.3Any construction works associated with the development hereby approved shall not take place except between the hours of 7:00 am and 7:00 pm Monday to Friday and 8:00 am and 1:00 pm on Saturdays. No construction shall take place on Sundays, Good Friday, Christmas Day or Bank Holidays. Reason for Condition: To safeguard the amenities of nearby residential properties, in accordance with PPG24 - Noise and policy DC1 of the adopted Rossendale District Local Plan.4The bin storage, cycle parking and solar panel details hereby approved shall provided prior to the development first being occupied and thereafter maintained for as long as the use remains in existence. Reason for Condition: To ensure sustainable development and to prevent the proliferation and untidy accumulation of bins in the interest of visual amenity pursuant to Policy DC1 - Development Criteria of the Rossendale District Local Plan.5The car parking spaces including the garages as shown on plan 08-017-05-F shall be provided and made available for use prior to the development hereby approved first being occupied and shall thereafter be maintained free of obstruction and available for use in perpetuity. Reason for Condition: To ensure adequate off-street parking within the site in the interest of highway safety pursuant to policy DC1 of the Rossendale District Local Plan.6Prior to the commencement of development on site, there shall be submitted to the Local Planning Authority for their approval, a programme of archaeological work. The implementation of the programme of work must be carried out in full accordance with the agreed details and prior to the commencement of development on site. Reason for Condition: To ensure and safeguard the recording and inspection of matters of archaeological/historical importance associated with the site in accordance with RSS policy EM1 and policy DC1 of the Rossendale District Local Plan.7Prior to the commencement of development on site, samples of the natural stone and natural slate to be used in constructing the development, and details of the materials to be used in the hard-surfaced external areas, including driveways, to be constructed in a permeable surface shall be submitted to and approved in writing by the Local Planning Authority. The development shall be constructed in accordance with the approved samples and details and thereafter maintained in perpetuity. Reason for Condition: In the interest of visual amenity to accord with Policy DC 1 of the adopted Rossendale District Local Plan.8Prior to the commencement of development on site, a detailed scheme of landscaping shall be submitted to and approved in writing by the Local Planning Authority. Any planting, seeding or turfing comprised in the approved landscaping scheme shall be carried out in the first planting and seeding seasons following the development hereby approved first being occupied and any trees or shrubs which within a period of 5 years of planting die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species, unless the Local Planning Authority gives written consent to any variation. Reason for Condition: In the interests of visual amenity to accord with Policy DC1 of the Rossendale District Local Plan.9Prior to the commencement of development on site, a precautionary repeat ecological survey of the site should be conducted, as recommended in the bat report dated 28/10/2009, and should be submitted to and approved by the Local Planning Authority. The development should be carried out in accordance with the approved re-survey document and the recommendations given in paragraphs 10.2 - 10.8 of the bat report dated 14/08/2009 unless otherwise amended having regard to the re-survey document. Reason for Condition: In the interests of safeguarding species protected under the Wildlife and Countryside Act 1984.

10Prior to the commencement of development on site:a. A Phase II site investigation shall be carried out and the results submitted to, and approved in writing by, the LPAb. Should the Phase II investigations indicate that remediation is necessary, then a Remediation Statement shall be submitted to, and approved in writing by, the LPA. The remedial scheme in the approved Remediation Statement shall then be carried out in accordance with approved details.c. Should remediation be required, a Site Completion Report detailing the conclusions and actions taken at each stage of the works including validation works shall be submitted to, and approved in writing by the LPA prior to the first use or occupation of that part of the development hereby approved. Reason : To ensure the site is suitable for its end use and the wider environment and does not create undue risks to site users or neighbours during the course of the development, to accord with Policy E7 of the adopted Rossendale District Local Plan.

The scheme is acceptable in principle in relation to housing policy and contaminated land and would not be detrimental to neither visual or residential nor highway safety and therefore accords with PPS1, PPS3 and PPS23, RSS polices DP1-7&9, RT2 & 4 and EM1 and the following policies of the Rossendale District Local Plan DS1, DC1 and DC4 and the RBC - Interim Housing Policy Statement - July 2008.
