SITUATION

The site at Tamarisk fronts onto Tregaller Lane within the hamlet of Daws House. Launceston and the A30 dual carriageway spine road for Cornwall and Devon is approximately a mile.   In the opposite direction the village of South Petherwin is a similar distance providing public house, primary school, church, chapel and post office.  

Launceston provides a full range of social, commercial and shopping facilities. 

The city of Exeter (44 miles) to the east offers a more extensive range of shopping facilities, an international airport, intercity rail link and M5 motorway link.  

The site at Tamarisk fronts onto a relatively quiet unclassified lane.   In all directions there are areas of outstanding natural beauty.    To the north the North Cornish coast famed for its National Trust cliff scenery and former fishing villages, to the west Bodmin Moor provides open spaces for walking and riding.   To the east is the Dartmoor National Park and running south is the hidden Tamar Valley steeped in 18th Century mining history.

THE SITE

The site has a frontage of approximately 22m and a depth of approximately 13m providing a total area of 312 sq m or 3,357 sq ft which is about a thirteenth of an acre.

The site has a south westerly aspect, a regular shape and a level topography. 

ACCESS TO PLOT

A section of the 6 foot boundary fence separating the plot from the    retained garden of Tamarisk has been left open for easy access via the garden of Tamarisk Cottage.

PLANNING CONSENT

Outline planning consent was granted under cover of Application and Decision Number PA14/09250 dated 24th November 2014.

The consent is subject to four conditions:-

1. Application for approval of the reserved matters shall be made to Cornwall the Local Planning Authority before the expiration of three years from the date of this permission.

2. The development hereby permitted shall be begun either before the expiration of three years from the date of this permission, or before the expiration of two years from the date of approval of the last of the reserved matters to be approved, whichever is the later.

3. Before any other building or engineering works are carried out on the site, details of the access construction including its surfacing, drainage, sight lines as well as swept path overlay detailing vehicle access site whilst second vehicle is in situ shall be submitted to and approved in writing by the Local Planning Authority.  The access shall be laid out and constructed in accordance with the approved details prior to the first occupation of the dwelling hereby approved and maintained and retained thereafter.

4. The development is hereby permitted shall be carried out in accordance with the plans listed below under the heading “Plans Referred to in Consideration of this Application”.

COVENANTS

The building plot will be sold, subject to the following easements and covenants:-

1. There will be an Easement in favour of the building plot granting to the building plot the right to trim or shave off a section of the frontage hedge remaining with Tamarisk garden should such be necessary to create a required visibility splay for the access to the site as shown on the indicative dwelling site plan scale 1:500.

2. The site is sold subject to a Covenant restricting development to one single storey dwelling without dormer or velux windows within the roof.

3. The plot is sold subject to a Covenant precluding the provision of windows in the north west elevation of the property so as to ensure the remaining garden of Tamarisk is not overlooked.

4. The plot is sold subject to a Covenant precluding the planting of shrubs or trees in excess of 1.8m in height against the boundary fence of Tamarisk.

PLEASE NOTE: The 6’ boundary fence separating the plot from the remaining Tamarisk garden will be erected by the Vendors, but thereafter same shall be a party fence as between Tamarisk Cottage and the building plot with each side responsible for decorating their side of the fence as necessary.

SERVICES

It is understood mains water, electricity and sewerage are available to the plot. Prospective purchasers should verify for themselves the availability and connection costs of any services they require.

MAINS SEWER CONNECTION TO TAMARISK

On the Location Map please note the alignment of the mains sewer connection for Tamarisk which runs through the site. The alignment of this section of sewer will need to be changed to accommodate the construction of the proposed dwelling on the site for sale. The vendors will co-operate with the purchaser for the re-alignment of this sewerage connection including, if necessary, the construction of an additional manhole within the garden to be retained with Tamarisk Cottage.

AUCTION DOCUMENTS

The auction contracts, answers to preliminary enquiries and local search will be available from the agents’ office for inspection during the two weeks prior to the auction or otherwise  by arrangement with the vendor’s solicitors.  The contract of sale will be available for inspection at the vendor’s solicitors, in the two weeks prior to the auction.  Auction packs will be available to purchase from the vendor’s solicitors.  The contracts will not be read at the auction.  Intending purchasers will be presumed to have full knowledge of the property and the contract.

Please Note: search fees paid by the vendor’s solicitors in putting together the auction documents will be recoverable from the eventual purchaser over and above the purchase price for the property.  The search fees will be approximately £367.64.
